¿Me podrían decir si hay que usar el subjunitvo en estas frase, por favor?

Aparte de que no sea así, es.../Aparte de no ser así, es...

Aparte de que es así, es.../Aparte de ser así, es...

I think you could use both subjunctive or indicative, but with different meanings. With subjunctive, you're not stating whether or not you think it's true. With ~~subjunctive~~ indicative you are.

Aparte de que es peligroso, perderás tu licencia. (You're stating as a fact that it's dangerous)
Aparte de que sea difícil, cuesta mucho dinero. (You're saying that it might be difficult.)

What do the native speakers think? Am I on target? :)
