Son parecidos pero no coinciden un 100%, pues el timo incluye hurto mediante engaño, como en el "cuento del tío", mientras que la estafa puede incluir llevarse algo con la falsa promesa de pagarlo luego.

El timo se centra más en el acto del engaño mientras que la estafa se centra más en el perjuicio, por eso es el nombre legal del delito.
