How can we traslate this in English?
It´s used in at court in a trial.

But only in court in the USA surely, seeing that it refers to the American Constitution? (so why is a translation into English wanted )

El claro que la quinta enmienda se había convertido a un dicho para cualquiera circunstancia en que una persona quiere quedar silenciosa.

En Estados Unidos siempre se puede decir I'll plead (o take) the 5th
cuando no quiere contestar algo. No tiene que estar en un juicio.

En Estados Unidos es así, pero en la Constitución española no hay enmiendas, hay disposiciones, y ni siquiera hay una quinta adicional (en todo caso, transitoria). Que una española diga que se acoge a la quinta enmienda es porque lo ha aprendido en las películas norteamericanas.

Bueno, en mis tiempos, en España, simplemente decíamos: "Me niego a responder". Y como dicen los catalanes, "Muts i a la gavia"... aunque eso creo que se usa para hacer callar a los niños... pero me recuerda a "mum's the word" que se usa para estarse calladito y no revelar nada...

Yo creo que en nuestra tierra se tiende uno a "acoger" al "derecho al pataleo"... Que es todo lo contrario...

Y en cuanto a "quintos, quintos, quintitos..." pues unos dos o tres de San Miguel para refrescar el gaznate. (Con un pincho de tortilla española...)

Ten cuidado si pides un "quinto", que hay sitios en los que no te van a entender porque dicen "botellín". Igual con la "mediana" y el "tercio".

Gracias por la advertencia... ya veo cómo va cambiando el léxico cotidiano... En mis tiempos, "una mediana o dos" después de tres horas de entrenamiento, me las bebía como agua... ahora, me das un botellín... y me mareo... Bueno, mejor me acojo a la quinta y no cuento mis historias del abuelo...
