I writing a paper and I'm very confused with being vs been. What is the rule? Can someone help?

That said ...
Both of these expressions can be entirely eliminated and the part that follows will still make perfect sense. The usage here is adverbial.
You can also use 'that having been said'.
'Being' is the present participle and 'been' is the past participle of the verb 'be'.
The present participle is used in the formation of the progressive or continuous form of the verb. The auxiliary, or helping, verb is 'be'.
The past participle is used to make the perfect tense. The auxiliary verb is 'have'.
We are being tested. (the testing is in progress)
We have been tested. (the testing is completed)
