-The union says it won't rule out calling a strike in the second half of August as the management has failed to respond to their demand by the 10 am deadline they set this morning.

If the speaker is speaking after the deadline, is has failed correct?

Yes, it is fine to use either the perfect tense or the past tense. The first means the failure is still present in the speaker's mind.
